Terms and Conditions of Use

Kooindaa App

Version: September 27, 2026

PREAMBLE

These Terms and Conditions of Use (hereinafter the "Terms") govern the use of the Kooindaa mobile application (hereinafter the "App").

Kooindaa is a standalone solution that lets the user manage personal data, including information about their health, treatments, appointments, and certain emergency situations.

The App is a tool to help manage information; it can under no circumstances be regarded as a medical device. It records the data entered by the user and provides reminders based on it.

Limits on use

The Kooindaa App must be used solely for its intended purposes. Accordingly:

  • it does not calculate any dosage;
  • it does not modify any dosage;
  • it does not issue any health recommendation;
  • it does not provide any care;
  • it does not establish any diagnosis.

Users are reminded that only the prescriptions of their doctor or an authorised healthcare professional are authoritative for their treatments. The App never replaces healthcare professionals or emergency services. In an emergency, or for any question relating to your health, always contact emergency services, your doctor, or qualified medical staff first.

The App may rely on various carriers, including compatible NFC devices and QR codes, to enable certain features.

The User is free to use a carrier or not, to use one they already own, or to obtain one from a supplier of their choice, provided it is compatible with the relevant feature.

The Kooindaa App is not a sales platform and does not offer any purchase journey for carriers.

Using the App is not conditional on any obligation to buy a carrier from the Publisher, nor on the use of any specific carrier.

These Terms are intended to govern the use of the App and to inform the User of their rights and obligations. They do not constitute general terms of sale, nor the terms applicable to any purchase of a product from the Publisher.

1. IDENTIFICATION OF THE PUBLISHER

The Kooindaa App is published by:

56 KOOINDAA, a French simplified single-shareholder joint-stock company ("société par actions simplifiée unipersonnelle" – SASU), registered with the Paris Trade and Companies Register under number: 109 762 195, registered office: 61 rue de Lyon, 75012 Paris, France.

Email address: bonjour@kooindaa.app,

hereinafter referred to as the "Publisher".

2. DEFINITIONS

  • Publisher: refers to 56 KOOINDAA SASU.
  • User: refers to any person installing or using the App.

  • Device: refers to any phone, tablet, or compatible equipment allowing the App to run.
  • Carrier: refers to any physical or digital carrier that can be used with a feature of the App.
  • NFC Carrier: refers to any hardware device compatible with NFC technology that may be used with certain features of the App.
  • QR Code: refers to any two-dimensional code generated or used by the App as part of certain features.
  • Visual Material: refers to any graphic material provided by the Publisher for use with the App.
  • Third-Party Service: refers to any service, application, system, or platform not published or controlled by the Publisher.
  • Health Tracking: refers to the App's features relating to treatment tracking and appointment management, which require a Subscription under the terms of article 30.
  • Subscription: refers to the paid subscription giving access to the Health Tracking features, under the terms of article 30.

3. ACCEPTANCE OF THE TERMS

Installing or using the App constitutes acceptance of these Terms.

If the User does not accept the Terms, they must stop using the App.

These Terms apply subject to any mandatory legal provisions applicable to the User.

4. LEGAL CAPACITY AND USE BY A MINOR

The User confirms that they have the legal capacity required to accept these Terms and use the App.

Where a minor uses the App, it must be used under the responsibility and with the consent of the holder of parental authority, who accepts these Terms on the minor's behalf.

If the User enters information relating to a third party in the App, including a family member or a minor, they confirm that they are duly authorised to do so and remain responsible for that data, including keeping it up to date.

5. NATURE AND INDEPENDENCE OF THE APP

The Kooindaa App is a standalone application.

Accessing the emergency identification features does not require:

  • creating an account with the Publisher;
  • a Subscription or any payment to the Publisher;
  • using any particular physical carrier;
  • using an NFC carrier.

Certain features, in particular those relating to Health Tracking, require a paid Subscription, on the terms set out in article 30.

The App's features can be used independently of one another, depending on what the version of the App in use offers.

In particular, the User can create and view emergency identification information without a Subscription and without using an NFC carrier.

6. FEATURES OF THE APP

The Kooindaa App may in particular allow the User to:

  • record and manage certain personal information;
  • record certain information relating to their health or treatments;
  • manage appointments;
  • prepare certain information intended to be accessible in an emergency;
  • use compatible NFC carriers;
  • generate or use QR codes;
  • share certain information or features, depending on what the App offers.

The list and terms of these features may change as new versions of the App are released.

The Publisher may modify, improve, add, or remove certain features, in particular for reasons of security, compatibility, or technical or regulatory changes.

7. USE OF NFC CARRIERS

The App may allow the User to write to certain NFC carriers compatible with the features on offer.

The App does not require the use of any particular NFC carrier.

The User may use:

  • a carrier they already own;
  • a carrier obtained from a supplier of their choice;
  • or no NFC carrier at all.

The Publisher does not guarantee that any given NFC carrier will be compatible with all of the App's features.

Compatibility may in particular depend on the characteristics of the carrier and of the equipment used.

The User must check that a carrier they wish to use is compatible before associating it with a feature of the App.

Using an NFC carrier is not a condition for accessing the other features of the Kooindaa App.

8. USE OF QR CODES

The App may allow QR codes to be generated or used as part of certain features.

Using a QR code does not require purchasing a carrier from the Publisher.

The User may use whatever means they choose to store, display, or share a QR code, subject to the terms of use of the feature concerned.

Reading a QR code may depend on the equipment used and the conditions in which the code is presented.

9. USE OF VISUAL MATERIALS

The App provides printable visual materials, intended to be attached to the User's NFC devices to help identify them in an emergency or to help recognise medication packaging. These materials are provided to help with reading the encoded carriers for their intended purpose; the Publisher does not guarantee that they will always be recognised. It is the User's responsibility to make sure that any third party who comes into contact with the carrier is able to understand what it means. The Publisher cannot be held liable for a failure to understand, a misinterpretation, or a lack of awareness of the information shown on the visual material.

10. MANAGING APPOINTMENTS

The Kooindaa App may allow the User to record and manage appointments.

This feature is intended to help the User organise their own schedule.

It does not, in itself, constitute a service for booking appointments with a professional.

The User remains responsible for the information they enter and for checking their appointments.

11. HEALTH-RELATED INFORMATION

Certain features of the Kooindaa App may allow the User to record health-related information, including information about treatments, allergies, or other information they wish to keep or make accessible.

The User is responsible for the accuracy and currency of the information they provide.

The Kooindaa App is a tool for managing and making information available.

Unless expressly stated otherwise, the App:

  • is not a medical diagnostic device;
  • does not provide medical consultations;
  • does not prescribe any treatment;
  • does not modify any prescription;
  • does not replace the advice of a healthcare professional.

In a medical emergency, using the Kooindaa App does not replace calling the relevant emergency services.

12. INFORMATION INTENDED FOR AN EMERGENCY SITUATION

Certain features may allow the User to prepare or make accessible certain information intended to help a third party consult it in an emergency.

The User chooses what information to make accessible for this purpose. It is up to them to check that it is accurate and up to date.

The User must bear in mind that information they choose to make available through a Carrier or another feature intended for this purpose may potentially be accessed by others.

The Kooindaa App does not guarantee that a third party will be able to access the information in every circumstance.

Whether a piece of information can actually be accessed may in particular depend on the equipment used, its compatibility, and the physical conditions of use.

The Kooindaa App is not a device that guarantees the intervention of an emergency service or a healthcare professional.

13. DATA RECORDED IN THE APP

Data entered by the User in the App is processed solely for the purposes of using it. It is never transmitted to the Publisher under any circumstances.

The Publisher:

  • does not receive this data;
  • does not keep any copy of it;
  • does not view it;
  • cannot access it remotely;
  • cannot retrieve it remotely.

The App is designed so that the Publisher has no technical means of remotely accessing data recorded by the User. This is a fundamental feature of how the Kooindaa App works. It is not simply a commitment made by the Publisher, but a consequence of the App's very structure: the User's data is stored securely on the Device, in line with the protection mechanisms provided by its operating system.

14. CONSEQUENCES OF THE PUBLISHER HAVING NO ACCESS TO THE DATA

The fact that the Publisher has no access to data stored in the App means, in particular, that it cannot:

  • view this data at the User's request;
  • remotely retrieve data that has been deleted or lost;
  • remotely restore the data of a lost or replaced Device;
  • provide a copy of data it has never had access to.

The User bears full responsibility for looking after their Device and the data recorded on it.

Loss, destruction, resetting, or replacement of the Device, as well as deletion of the App or its data, may result in the permanent loss of the information concerned.

It is up to the User to use whatever backup means are available to them to keep a copy of their data.

Any backup features offered by the operating system or by third-party providers are independent of the Kooindaa App.

15. SHARING INFORMATION

Certain features allow the User to share information or to allow it to be viewed by a third party.

The User remains responsible for the data they choose to share, as well as for the recipients to whom they grant access.

Sharing a piece of information does not mean it is transmitted to the Publisher.

Where sharing takes place via a link or a carrier, the content concerned is not transmitted to the Publisher, even if it is opened in a web browser. For treatment-tracking and appointment features, this data is additionally encrypted and can only be accessed using a key provided by the User at the time of sharing. The technical details are set out in the Privacy Policy.

Access granted to a shared treatment tracking is limited in time: it ends automatically the day after the treatment ends. The User who created a tracking may also revoke, at any time and from within the App, the access they have granted. These mechanisms do not make it possible to delete information that the recipient may have viewed or reproduced beforehand; it is up to the User to take this into account when choosing their recipients.

Where a third-party service is used to share or transmit information, any processing carried out by that service is governed by its own terms and policies.

16. THIRD-PARTY SERVICES

Certain features may call on or activate services present on the User's device. These services include, in particular, a browser, a messaging app, an email client, or other third-party solutions.

Certain translation features rely on a local component: the operating system's translation service on iOS, or the Google module built into the App on Android. Translation is carried out locally on the device; the data concerned is not transmitted to a server. These points are set out in the Privacy Policy.

The Publisher has no control over the processing carried out by these services.

Where the User chooses to use a third-party service, they are responsible for reading the terms and information relating to that service.

17. PROTECTION OF PERSONAL DATA

The terms on which personal data is processed are set out in the Kooindaa App's Privacy Policy. This document, separate from these Terms, sets out, where applicable:

  • the categories of data processed;
  • the purposes of the processing;
  • the legal bases;
  • the recipients;
  • the retention periods;
  • the rights of the individuals concerned;
  • how to exercise these rights;
  • the identity and contact details of the data controller;
  • the procedure for lodging a complaint with the CNIL.

18. DEVICE PERMISSIONS AND FEATURES

Certain features of the Kooindaa App may require access to functions or capabilities of the Device.

The User may be asked to grant the permissions needed for these features to work properly.

Depending on the services requested, these permissions may relate to NFC technology, the camera, displaying notifications, saving images to the photo library, certain security or authentication features (biometrics, passcode), and, on Android, access to the internet solely to download the language pack used for local translation.

The permissions available depend on the operating system and version of the Device in use.

Declining a permission may prevent the relevant feature from working, without necessarily preventing use of the App's other features.

19. AVAILABILITY AND EVOLUTION OF THE APP

The Publisher undertakes to ensure that the Kooindaa App works optimally. However, it may be temporarily unavailable, in particular due to:

  • maintenance operations;
  • updates;
  • changes to the operating system;
  • compatibility issues;
  • device failures;
  • events beyond the Publisher's control.

The Publisher may develop the App further, in particular to improve its security, compatibility, or features.

20. USER RESPONSIBILITY

The User undertakes to use the Kooindaa App in accordance with its purpose and with applicable laws and regulations. In particular, they are responsible for:

  • the data they enter in the App;
  • how they use the features on offer;
  • the security of their Device;
  • looking after their Carriers;
  • any information they choose to share;
  • their use of any third-party services they access.

The User must not use the App in a way that infringes the rights or safety of a third party.

21. INTELLECTUAL PROPERTY

The Kooindaa App, its code, interface, structure, graphic elements, text, content, trademarks, distinctive signs, and all of its components are protected by applicable intellectual property rights, subject to their legal validity.

The Publisher, or the relevant rights holders, retain all rights not expressly granted to the User.

Using the App does not transfer any ownership right over it or its components.

The User only has a right to use the App in line with its intended purpose and these Terms.

22. LIMITS ON THE RIGHT TO USE

Except with the express permission of 56 KOOINDAA or as required by mandatory law, the User may not, in particular:

  • reproduce the App beyond what is strictly necessary for their own use;
  • distribute or sell it;
  • make a copy of it available to third parties outside the terms provided for;
  • remove or alter any notices relating to intellectual property rights;
  • commercially exploit the protected elements of the Kooindaa App without authorisation;
  • reproduce or exploit these elements to design a product or service that infringes the Publisher's rights.

These restrictions apply subject to any rights and exceptions provided for by law.

23. KNOW-HOW AND NON-PUBLIC INFORMATION

The technical characteristics, methods, processes, design choices, and non-public documents and information relating to the Kooindaa App may be regarded as confidential or protected under applicable law.

The User must not make any unlawful use or disclosure of any non-public information they may have access to in the course of their relationship with the Publisher.

This article does not grant any protection beyond what is provided for by law, and does not restrict any rights the User holds under the law.

24. PROHIBITED USES

Using the Kooindaa App is expressly prohibited:

  • for fraudulent or unlawful purposes;
  • in a way that infringes the rights of a third party;
  • in a way that compromises the security or operation of the App;
  • in an attempt to gain unauthorised access to a third party's data;
  • to distribute content whose distribution is prohibited by law;
  • to unlawfully bypass the App's security features.

These prohibitions apply subject to any rights and exceptions provided for by law.

25. NO ABSOLUTE WARRANTY

The Publisher takes measures intended to ensure the security and performance of the App. However, no software or computer system can be considered entirely free of defects, failures, or vulnerabilities. In particular, the Publisher cannot guarantee that the App will run uninterrupted on all devices or operating systems.

26. LIMITATION OF LIABILITY

The Publisher cannot be held liable for consequences arising, in particular, from:

  • use of the App that does not comply with these Terms;
  • a faulty or incompatible Device;
  • loss of or damage to a Carrier;
  • a failure of a third-party service;
  • an event of force majeure;
  • loss of data following the loss, destruction, resetting, or replacement of the Device, where that data is not accessible to the Publisher.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

27. CHANGES TO THE TERMS

The Publisher reserves the right to amend these Terms, in particular to reflect changes to the App, its features, technical developments, regulatory changes, or any adjustment needed for the service to operate. The version in force is the one made available to the User. Where a change requires the User to be informed or their consent obtained as a matter of law, the applicable regulatory requirements are complied with.

28. SUSPENSION OR TERMINATION OF USE

The User may stop using the Kooindaa App at any time.

They may also delete the App from their Device.

The Publisher may suspend or interrupt access to the App where necessary, in particular for reasons of security, maintenance, or service evolution, or where required by law.

Where possible and appropriate, the Publisher informs affected Users of significant interruptions via its website or other means.

29. APPS DISTRIBUTED VIA A THIRD-PARTY PLATFORM (APP STORE / GOOGLE PLAY)

The App is made available through third-party distribution platforms, including Apple's App Store and Google Play.

These Terms are entered into solely between the User and the Publisher, and not with the operator of the distribution platform.

The platform operator assumes no responsibility for the App or its content, and has no obligation of maintenance or support in that respect.

If the App fails to conform to an applicable warranty, the User may notify the platform operator, which may, where applicable, refund any price paid. Subject to the limits set out by applicable law, the platform operator has no other warranty obligation.

The Publisher, and not the platform operator, is responsible for handling any claims from the User or any third party relating to the App, its possession, or its use, including in relation to product liability, compliance with legal and regulatory obligations, and consumer protection.

Where a third party claims that the App or its use infringes their intellectual property rights, the Publisher, and not the platform operator, is responsible for handling that claim.

The User confirms that they are not located in a country subject to an applicable embargo, and that they do not appear on any official list of prohibited persons or entities.

The User undertakes to comply with the terms of use in force of the platform through which they obtained the App.

Apple Inc. and Google LLC, and their affiliates, are third-party beneficiaries of these Terms and may enforce them against the User.

30. HEALTH TRACKING SUBSCRIPTION

Access to the treatment tracking and appointment management features, referred to as "Health Tracking", requires a paid subscription (the "Subscription").

The emergency identification features remain accessible without a Subscription, without creating an account, and without any other payment to the Publisher.

The Subscription is offered in several plans, whose duration, price, and any free trial terms are displayed within the App before purchase, in accordance with the terms of the distribution platform through which the User accesses the App.

Unless cancelled by the User as set out below, the Subscription renews automatically at the end of each period, for the same duration and at the price in effect at the time of renewal.

A free trial period may be offered for certain Subscription plans. Unless cancelled by the User before it ends, the trial automatically converts into a paid Subscription, billed on the terms displayed at the time of purchase.

Subscribing to, managing, and cancelling the Subscription is done exclusively through the settings of the Apple or Google account associated with the User's Device. The Publisher plays no part at any stage in billing, payment, or cancellation of the Subscription, and has no means of carrying these out on the User's behalf.

Any refund request is subject exclusively to the policy of the distribution platform operator, in accordance with article 29 of these Terms.

Cancelling the Subscription does not affect data already recorded by the User, which remains stored on their Device under the terms of article 13. It may, however, restrict access to certain Health Tracking features until a new Subscription is taken out.

31. PARTIAL INVALIDITY

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain fully valid.

The provision concerned will, to the extent legally possible, be replaced by a valid clause that comes as close as possible to achieving its original intent.

32. LANGUAGE

These Terms are drafted in French, the reference language. Any translation is provided for information purposes only. In the event of any discrepancy in interpretation, the French version prevails, subject to any mandatory provisions applicable to the User in their country of residence.

33. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by French law.

Where the User is a consumer, any mandatory provisions applicable to them remain fully in effect.

In the event of a dispute, the User is invited to first contact the Publisher in order to reach an amicable resolution.

This step does not affect any rights or remedies the User has under the law.
